Terms of Service
These Terms of Service govern your use of MarkdownBrain, the MarkdownBrain website, and related hosted services (collectively, the "Service").
By creating an account, accessing, or using the Service, you agree to these Terms.
MarkdownBrain is operated by Thi Bui Ngoc.
1. The Service
MarkdownBrain is a Markdown-first knowledge management service.
The Service may allow you to:
- Create, edit, import, and export Markdown notes
- View notes in a connected graph
- Search and navigate your vault
- Use AI-assisted features that generate embeddings and suggest titles, tags, and related notes
- Use AI-generated suggestions without automatically changing your Markdown notes
MarkdownBrain may change, improve, add, remove, or discontinue features over time.
2. Your Account
You must be at least 18 years old, or have the permission of a parent or legal guardian, to use the Service.
You are responsible for:
- Providing accurate account information
- Keeping your login credentials secure
- All activity that occurs through your account
- Informing us promptly if you believe your account has been accessed without permission
3. Your Content
You retain ownership of the notes, files, text, and other content you submit to MarkdownBrain ("User Content").
You grant us a limited right to host, process, store, transmit, and display your User Content only as needed to provide, maintain, and secure the Service.
You are responsible for ensuring that you have the rights to upload or use your User Content.
Do not submit content that is unlawful, infringes another person's rights, contains malware, or violates these Terms.
4. AI-Assisted Suggestions
MarkdownBrain may use automated systems and AI models to generate embeddings and suggest titles, tags, and related notes from your note content.
AI-assisted processing may occur after you create or edit a note, and does not automatically change your Markdown notes.
AI-generated suggestions may be incomplete, inaccurate, or unsuitable for your specific situation.
You are responsible for reviewing AI-generated suggestions before relying on them.
MarkdownBrain does not guarantee that automated suggestions are correct, complete, or appropriate for legal, medical, financial, security, business, or other high-stakes decisions.
Our Privacy Policy explains how AI-assisted processing handles your data.
5. Acceptable Use
We may suspend or terminate access where we reasonably believe these rules have been violated.
You may not use the Service to:
- Break any applicable law or regulation
- Upload malware, harmful code, or material intended to disrupt the Service
- Access another user's account or data without permission
- Attempt to bypass usage limits, billing controls, or security measures
- Reverse engineer, scrape, overload, or interfere with the Service
- Use the Service to violate intellectual-property, privacy, or other rights
- Upload content involving illegal exploitation, abuse, or harmful activity
6. Free and Paid Plans
MarkdownBrain offers Free and Pro plans.
Free plans may include limits on:
- Number of vaults
- Number of Markdown notes
- Storage capacity
- AI features or automated processing
- Feature availability
Paid plans may include higher limits and additional features.
Current plan details, pricing, billing frequency, and included limits are shown on the Pricing page and during checkout.
7. Billing and Subscriptions
Paid subscriptions are billed in advance on a recurring basis, such as monthly or yearly, depending on the plan you select.
Lemon Squeezy is the merchant of record for paid subscriptions and processes payments. Your purchase may also be subject to Lemon Squeezy's terms.
You authorize us or our payment provider to charge the applicable subscription fee and any applicable taxes.
You may cancel your subscription at any time through your account or billing portal. Cancellation will take effect at the end of the current billing period unless otherwise stated during checkout.
A failed payment may result in a past-due, unpaid, or expired subscription status. We may restrict or suspend Pro features until billing is resolved or you restart your subscription.
Unless required by law, payments already made are non-refundable.
8. Plan Changes and Limits
You may upgrade or downgrade your plan where available.
If you exceed a plan limit, we may restrict additional uploads, storage, AI usage, or other usage until you upgrade, reduce your usage, or the next usage period begins.
If you downgrade, features or capacity available on your prior plan may no longer be available.
You are responsible for exporting or removing content if needed before downgrading.
9. Import and Export
MarkdownBrain supports Markdown-first workflows.
Importing Markdown files and exporting your vault as a ZIP file are currently available on both Free and Pro plans.
We recommend that you maintain your own backups of important content.
We do not guarantee that imported content, links, formatting, or metadata will always be interpreted perfectly.
10. Availability and Changes
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation.
The Service may be unavailable due to maintenance, updates, outages, third-party failures, security incidents, or circumstances beyond our control.
We may modify, suspend, or discontinue parts of the Service. Where practical, we will provide notice of material changes.
11. Termination
You may stop using MarkdownBrain at any time.
We may suspend or terminate your account if:
- You violate these Terms
- You misuse the Service
- We are required to do so by law
- Continued access creates a security, legal, or operational risk
Where reasonably possible, we will allow you to export your content before account termination. This may not apply where we are legally prohibited from doing so or where immediate suspension is necessary for security reasons.
12. Intellectual Property
MarkdownBrain, including its software, branding, interface, design, and service content, is owned by or licensed to us and protected by applicable intellectual-property laws.
These Terms do not give you ownership of the Service or its underlying technology.
You may not copy, modify, distribute, sell, lease, or create derivative works from the Service except where permitted by law or expressly authorized by us.
13. Disclaimers
The Service is provided on an "as is" and "as available" basis.
To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and accuracy.
MarkdownBrain is not a backup service, legal advisor, financial advisor, medical advisor, or security advisor.
You should keep independent backups of important content.
14. Limitation of Liability
To the maximum extent allowed by law, MarkdownBrain and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, business, goodwill, or opportunity.
Our total liability for claims related to the Service will not exceed the amount you paid us for the Service during the 12 months before the event giving rise to the claim.
Nothing in these Terms limits liability where it cannot be limited under applicable law.
15. Privacy
Our Privacy Policy explains how we collect, use, store, and protect personal data.
By using the Service, you acknowledge that your personal data will be handled as described in the Privacy Policy.
16. Changes to These Terms
We may update these Terms from time to time.
When we make material changes, we may notify you through the Service, by email, or by updating the "Last updated" date above.
Your continued use of MarkdownBrain after updated Terms take effect means you accept the updated Terms.

18. General Terms
These Terms and the Privacy Policy form the entire agreement between you and MarkdownBrain regarding the Service.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
Our failure to enforce a provision of these Terms is not a waiver of that provision.
We may assign these Terms in connection with a merger, acquisition, sale of assets, or other business transfer. You may not assign these Terms without our written consent.
We may provide notices about the Service or these Terms through the Service or the email address associated with your account.
